CA AB 1331 – Monitoring & Surveillance

Employers may face new limits on tracking employees, especially in private or off-duty spaces.

As part of the wave of 2025 proposed California workplace legislation, AB 1331 aims to place clear limits on employer surveillance, a critical issue for protecting employee dignity and privacy.

If passed, AB 1331 would:

🔎Ban surveillance in private, off-duty areas (like bathrooms, locker rooms, breakrooms & lactation spaces)
🔎Prohibit monitoring employees during off-duty hours
🔎Forbid surveillance of a worker’s home or personal vehicle
🔎Regulate electronic tracking of work pace, location, or other biometrics

Reminder: The California legislative session ends September 12, 2025, with the Governor’s deadline to sign or veto bills on October 12, 2025.

This is one of several major bills that both CA employers and workers need to keep on their radar.
